Tape of Murray Interview to Be Played in Court

(AP) - Prosecutors are expected to play for jurors a police interview conducted with the doctor charged in Michael Jackson’s death, during which he lays out his version of events in the final hours of the singer’s life.


The more-than two hour interview has never been played in public before, nor has a transcript of its contents been released. In it, Dr. Conrad Murray details his treatments on Jackson in the hours before the singer’s death, including his administration of the anesthetic propofol.

The interview was conducted by two Los Angeles police detectives, one of whom, Scott Smith, will introduce the interview for jurors during the trial’s ninth day on Friday, prosecutors have told a judge.
The interview will be played after defense attorney J. Michael Flanagan finishes cross examination of coroner’s toxicologist Dan Anderson. On Thursday, Anderson told jurors that propofol was found in various parts of the singer’s body, his blood and urine during an autopsy. The amounts found led coroner’s officials to conclude that Jackson died from acute propofol intoxication, with other sedatives administered by Murray contributing to the singer’s death.
Defense attorneys contend Jackson gave himself the lethal dose after Murray left the room. Flanagan attempted Thursday to get Anderson to say that high levels of the sedative lorazepam found in Jackson’s stomach meant that he swallowed the drug himself. Anderson told jurors he couldn’t determine that based on the information he had.

Murray has pleaded not guilty to involuntary manslaughter and faces up to four years behind bars and the loss of his medical license if convicted.
Murray’s police interview two days after Jackson’s death on June 25, 2009 is one of the last big pieces of evidence prosecutors have to present against Murray. According to search warrant affidavits, police said Murray detailed his treatments of propofol and other drugs to try to get Jackson to sleep.

The Houston-based cardiologist, who was accompanied by an attorney during the interview, told detectives that he had been trying to wean Jackson off propofol because he was afraid he was addicted. He told the police he had given the singer other sedatives, including lorazepam and midazolam, in the hours before Jackson’s death, but that the singer couldn’t fall asleep.
Murray told the police that he had only left Jackson alone for a couple minutes when he returned around 11 a.m. on June 25, 2009 to find the singer had stopped breathing. Murray’s attorneys have disputed this portion of the timeline and say the doctor returned to find Jackson unresponsive around noon.

In the interview, the physician also told detectives that other doctors had given Jackson propofol as a sleep aid in the past. The singer called it his “milk,” according to descriptions of the interview included in search warrant affidavits.
The doctor also told police during the question-and-answer session where vials of propofol that remained in Jackson’s rented mansion could be found. The disclosure led police to search the singer’s bedroom and closet two days after the interview and turned up an IV bag, several drugs and creams to treat vitiligo and bottles of propofol.

Lead defense attorney Ed Chernoff on Thursday attacked the credibility of a coroner’s investigator who collected evidence at the house on the June 25 and June 29, 2009 searches of Jackson’s home. Chernoff noted that investigator Elissa Fleak had moved items in the room and failed to note in a report until nearly two years after Jackson’s death that she had found a bottle of propofol inside an IV bag.

Jackson’s bodyguard Alberto Alvarez described the bottle in the IV bag during testimony last week and in January during a preliminary hearing, leading Chernoff to question whether Fleak had added the detail to match Alvarez’s description. Fleak had photographed the bottle and IV bag together, but with the container placed outside the bag.

Fleak denied any wrongdoing, and denied Chernoff’s contention that she had made “a substantial number of mistakes.”
The investigator also acknowledged that she had handled a syringe without gloves, leaving a thumbprint on the item.
Walgren attempted to deflect the criticism, asking the investigator whether she had conducted a perfect investigation. No, she replied.
“Have you ever conducted a perfect investigation?” Walgren asked.
“No,” Fleak said.

A toxicologist and an attorney for Michael Jackson’s doctor jousted Friday over whether the presence of a sedative in the singer’s stomach was proof he swallowed the drug.

In a painstakingly slow cross-examination rife with highly technical terms such as “ion trapping” and “bioavailability,” the lawyer for Dr. Conrad Murray repeatedly suggested there was no other explanation.

And the witness repeatedly insisted there might be, but the question should be put to someone with more training.

How the minuscule amount of lorazepam found in Jackson’s stomach got there is in dispute at Murray’s manslaughter trial.

Murray acknowledged giving Jackson two injections of the drug, but his defense contends the singer later downed a handful of lorazepam pills without Murray’s knowledge.

Dan Anderson, a toxicologist at the Los Angeles County Coroner’s office, said that in his experience “drug levels can be detected in the stomach … that were not given orally.”
Pressed by defense attorney J. Michael Flanagan to explain given the specific properties of lorazepam, the witness demurred, saying he preferred “to leave it to the many experts who are going to march up here after me.”

Flanagan persevered, pressing Anderson on details including the absorption time of lorazepam and whether it was subject to “postmortem redistribution.”

Anderson, shifting in the witness chair, told the lawyer several times he was uncomfortable offering opinions.

“I personally would rather leave this to a pharmacologist who would be coming,” he said.

Both sides have retained stables of forensic experts to bolster their theories of Jackson’s 2009 death from the surgical anesthetic propofol.

Murray, 58, faces a maximum of four years in prison if convicted of involuntary manslaughter. His trial is concluding its second week of testimony.

AP) LOS ANGELES — Prosecutors have called a police detective who interviewed the doctor charged in Michael Jackson's death to introduce a recording of the session for jurors.

The seven-man, five-woman panel is expected to hear the more than two-hour interview conducted with Dr. Conrad Murray on Friday. In the session, Murray disclosed that he had been giving Jackson the anesthetic propofol as a sleep aid.

Detective Scott Smith will introduce the tape Friday and is expected to testify further about the investigation into Murray's actions at a later date.

The recording has never been played in public before, nor have its exact contents been released.

Murray has pleaded not guilty to involuntary manslaughter. If convicted, he faces up to four years behind bars and the loss of his medical license.

Dr. Conrad Murray admitted to police ... he administered dose after dose of multiple, powerful sleeping aids -- including Propofol -- over several hours .... before Michael Jackson died.

Prosecutors just played a portion of Dr. Murray's explosive 2-hour interview with police on June 27th, 2009 -- in which Murray claims Jackson "was unable to sleep naturally."

Murray told police, beginning around 1:30 AM, he gave MJ multiple doses of Lorazepam and Medazolam over the course of 9 hours on June 25th, 2009 to help the singer sleep -- but the drugs had no effect -- and then gave him other drugs as well.

Around 10:40 AM -- less than two hours before MJ's security guard called 911 -- Murray said he gave MJ 25mg of Propofol to put him to sleep ... claiming, "I took all precautions that were available to me."

Murray said he gave MJ Propofol daily -- with a few exceptions ... because he was trying to ween the singer off the "milk." According to Murray, "Michael loved that drug."

Massive Inconsistency In Murray's Story

Dr. Conrad Murray's interview with LAPD detectives reveals a huge inconsistency that could weigh heavily with the jury.

In the tape, Dr. Murray says he left Michael Jackson's room for only 2 minutes to go to the bathroom, and when he came back Michael Jackson was not breathing. Murray says he immediately began performing CPR.

But according to Sade Anding, Murray's Houston girlfriend who was on the phone with Murray, she says she was talking to him for a while when suddenly it appeared Murray dropped the phone and the emergency commenced.

So now there are competing stories -- Either Murray went to the bathroom as he told cops, or he was on the phone -- possibly distracted. If jurors believe Anding and the phone records, they could easily conclude Murray lied to cops.

LOS ANGELES (AP) — Jurors who have sat facing Dr. Conrad Murray for two weeks listened Friday as the physician detailed in a recorded interview his interactions and treatments on Michael Jackson in the months and hours before the singer's death.

Murray sounded calm on the more-than two hour recording as he spoke of their relationship, efforts to save his life and the medications he gave Jackson in his efforts to get him to fall asleep. It was the first time Murray's interview with police detectives had ever been played in public.

The June 27, 2009 interview outside a noisy hotel ballroom gave police their first hint that Jackson's death was not from natural causes and that he had been given the powerful anesthetic propofol in an effort to cure his extreme insomnia.
"He's not able to sleep naturally," Murray told the detectives early in the interview.
Just before court adjourned for the day, Murray is heard on the recording telling detectives that he had no intention of hurting Jackson. "I did not want him to fail."

Murray told the detectives how he met Jackson and walked them through the treatments he gave the singer on the day he died, including doses of the sedatives lorazepam and Versed.
Jackson remained awake for hours after returning home around 1 a.m. on June 25, 2009 after rehearsals for a series of comeback concerts. "It was 4 o'clock in the morning, and then he complained," Murray said. "'I've got to sleep Dr. Conrad. I have these rehearsals to perform.'"
Jackson threatened to cancel that day's rehearsal, so Murray gave him some more lorazepam.

In a calm, slightly accented voice, Murray told detectives that the singer remained awake and continued to complain about his lack of sleep.
Murray told detectives he relented to Jackson's demand for his "milk" — a nickname the doctor said the singer used for propofol, which is a milky-white liquid.

Detective Scott Smith was confused by the reference at first, asking whether Jackson wanted hot or cold milk. Murray then explained it was an anesthetic.
Over the course of the interview, Murray told police that other doctors had given the anesthetic before.
Defense attorney Ed Chernoff told the detectives that Jackson was familiar with how the drug was administered through an IV and certain dosages.
Murray told the detectives he took all possible precautions — keeping oxygen and a pulse monitoring machine nearby — and constantly warned Jackson that using propofol was an artificial way to sleep.

Prosecutors contend that Murray was reckless by giving Jackson propofol outside a hospital setting and without the proper monitoring equipment.
Murray said Jackson told him before he agreed to be his personal physician that he might need help. The physician said Jackson told him that he expected to sleep for 15 to 18 hours at a time.
He said Jackson told him, "'You don't quite know or understand that these hours are long."
"I think, on you, it will be too much," Murray said. "What Mr. Jackson knew is this is something he did every day."
Authorities claim Murray gave Jackson a lethal dose of propofol and other sedatives while trying to help the singer. Defense attorneys say Jackson gave himself the lethal dose after Murray left the room.


Murray has pleaded not guilty to involuntary manslaughter. If convicted, he faces up to four years behind bars and the loss of his medical license.
In the recorded interview, Murray recounted how the singer sought him out in early 2009 to help him prepare for his upcoming series of comeback shows.
"Then I got a call from Jackson telling me how elated he was that I was going to join the trip," Murray said. He said there was no commitment yet, but indicated how impressed he was about the request.
"Michael Jackson asked me to be on his team. I was talking to Michael Jackson himself," Murray said.

Asked about the arrangements that were made, he said, "I was of the opinion he would be my employer directly." He said he later learned that the promoter of Jackson's concerts, AEG Live, would be paying his salary.
Testimony showed that Jackson had agreed to pay Murray $150,000 a month.
In his testimony preceding the tape, Smith said, the case had not been classified as a homicide before Murray talked and was being treated as a death investigation, possibly from natural causes.
More than seven months after Murray's interview with detectives, he was charged with involuntary homicide.

Jurors heard a seemingly composed, even-keeled Conrad Murray describe how he came to care for Michael Jackson in the months leading up to the singer’s death, as the doctor’s interview with police was played Friday at his involuntary-manslaughter trial.

Speaking with an accent, the Grenada native spoke in a steady and measured voice as he responded to questions from Los Angeles Police Department detectives.

In the first few minutes of the interview played in the morning, Murray told police he first took care of Jackson in 2006 when the singer and his children had the flu.

He was introduced to the singer by a security guard who was a patient, Murray told detectives.

In the following years, he cared for Jackson “off and on, intermittently,” the doctor recalled.

Murray said he cared for Jackson for about two months the singer's June 2009 death.

He said the pop star’s assistant, Michael Amir Williams, called saying that Jackson “wanted very much” for the doctor to be part of his concert tour in London.

The doctor recounted telling Williams he would need more details “and shortly after, I got a call from Mr. Jackson about how elated he was that I was joining the trip,” even though he had yet to agree to sign on, Murray said in the interview.
Murray said it was later that he realized it would be the concert promoter AEG, not Jackson, that would be paying the salary for his work.

The physician’s 2 1/2-hour interview from two days after Jackson’s death has never before been made public, except for brief excerpts played last week by prosecutors during opening statements.

A detective has previously testified that during the interview, Murray said he administered a half-dose of the surgical anesthetic that killed Jackson, and that he had been trying to wean the entertainer off the drug.

LAPD Det. Scott Smith testified that the interview took place in a small office next to a banquet hall at the Ritz-Carlton Hotel in Marina del Rey. Music, rustling and chatting can be heard in the background.

In the recording, detectives told Murray that the interview would be used to assist the coroner in determining a cause of death for Jackson.

Jurors finally got to hear from the doc himself... in what's considered one of the most important pieces of evidence in the trial.

Detective Scott Smith introduced a two-hour audio recording he conducted with Murray two days after Michael Jackson died.

* In the audio, Murray sounded calm and collected as detectives ask him basic information.
* The meeting -- attended by Murray, his lawyer, and a second detective -- was held on June 27th at a hotel in Marina del Rey.
* Murray said on he arrived at MJ's house at 12:50 am on June 25th.
* MJ arrived at 1:05 am after his rehearsal saying he was tired and fatigued.
* Murray then rubbed a cream on his body to treat his Vitiligo.
* Murray said he gave MJ an IV in either his right or left leg, and a 10 mg Valium pill.
* MJ couldn't sleep so Murray gave him 2 mg Lorazepam IV.

* Murray said MJ complained he wasn't sleepy, so he gave him 2 mg of Midazolam around 2 am.

* At this point, MJ was begging for "Milk". Murray says finally relented and gave the singer 25 mg of Propofol around 10:50 am.

* Murray started doing CPR and mouth to mouth.
* Murray did chest compressions with one hand
* he couldn't take him off the bed so he improvised placing his left hand under the body.
* Murray said he continued compressions with one hand while calling MJ's assistant on his cell. He didn't ask him to call 911 because he said he was busy giving CPR.
* Murray lifted MJ's legs to get more blood to his heart.
* Murray went downstairs and asked Chef to get security. Security called 911.
* Murray continued doing CPR until paramedics came and hooked him up to pulse oximeter and got him intubated.
* Murray said he didn't call 911 because he didn't know the zip code for MJ's house.
* Murray said as he was caring for MJ paramedics were talking to UCLA and wanted to give up. He begged them to transfer care to him because MJ was his friend.
* He said he was in the ambulance with MJ as they transported him to UCLA
* Murray said they tried for about an hour.
* He said they the doctor at UCLA wanted to try a balloon pump to help start MJ's heart.
* After MJ was pronounced dead, the ER doctor asked Murray what had happened. Murray told her maybe it was massive pulmonary embolism.
* Murray said he didn't want to sign death certificate because he didn't understand the cause of death.
* Murray insists he was trying to wean MJ off Propofol 3 days before his death.
* Murray said he started to give MJ more Lorazepam and Diazepam to bring down the Propofol.
* Two night before he died Murray says no "Milk was given" and MJ slept well. Murray thought he was "on to something."
* But the next night it didn't work.

Anesthesiologist calls Murray's statements false

A Las Vegas anesthesiologist linked by Dr. Conrad Murray to the drug use of Michael Jackson did administer a sleeping drug to the pop star four times, but not under the conditions that Murray told investigators.

That account by Las Vegas attorney Libo Agwara came days after a search warrant was unsealed that revealed new details about the Los Angeles Police Department's investigation.

The warrant includes statements made by Murray, the Las Vegas doctor at the center of the investigation, who told authorities he administered propofol to Jackson minutes before he died. Murray told investigators that in March or April he witnessed Dr. David Adams administer the same drug to Jackson in a cosmetology office, according to the Los Angeles Times.

Agwara, Adams' attorney, said Murray's claims were false.

"My client has never been to a cosmetologist to do anything," Agwara said. "That doesn't make any sense."

Adams did administer the powerful drug to Jackson four times last year and did meet with Murray in March, Agwara said from his office on Sahara Avenue.

Adams, a roving anesthesiologist, has used the drug on more than 6,000 patients since he started practice in 2003. "All 6,000-plus people woke up," Agwara said.

Physicians in hospitals, medical centers and doctors offices contact Adams to put people under for surgeries and other medical procedures.

In 2008, a surgical dentist in Las Vegas contacted Adams for his services regarding a "VIP," Agwara said. The VIP was Jackson, and Adams was made to swear to confidentiality before doing the work. Agwara wouldn't say who the dentist was.

Jackson was undergoing "extensive dental work," Agwara said. Over the course of a few months, Adams administered the sedative four times for the dental procedures.

Adams didn't have contact again with Jackson until Murray called him in March. He did not know Murray, according to Agwara.

"Dr. Murray called, said 'Can we meet?'" Agwara said. "My client said, 'Who are you?' He said, 'Well, I'm Michael Jackson's personal doctor.' ... He said, 'Mr. Jackson remembered you from when you assisted in one of his surgical procedures.'"

Adams met with Murray and Jackson at Murray's office that month, Agwara said.

Agwara wouldn't say what took place during the meeting, but he said his client did not administer propofol or anything else to Jackson during the meeting. "Murray has never witnessed my client administer propofol to anyone," Agwara said. "He's never witnessed my client administer anything to anyone."

Authorities have subpoenaed medical records from Adams, the warrant states, according to the Los Angeles Times. But Agwara said his client has not been given a subpoena and has not been asked for medical records.

"The authorities have assured me time and again that my client has never been a target of any investigation, has never been under investigation, and they have not uncovered anything that will make him a target of any investigation," Agwara said.

Jackson died in June. A law enforcement official told The Associated Press this week that a coroner ruled the pop star's death a homicide and that a combination of drugs was the cause.

Agwara said Adams has not had any complaints or disciplinary action against him. The Nevada Board of Osteopathic Medicine's Web site shows Adams has not had any reports of malpractice or disciplinary issues.

Agwara said Murray has given propofol a bad name.

"It is a wonderful, wonderful drug for professionals who know how to use it in a medical setting," he said.
